Terms of Service

By accessing or using CostBasis (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and subscribers.

CostBasis is a software tool that helps Bitcoin and Ethereum holders calculate cryptocurrency cost basis, reconcile cross-platform transfers, and generate tax reports including IRS Form 8949 and Schedule D. The Service imports transaction history from connected exchanges and public blockchain addresses using third-party APIs.

CostBasis does not provide tax advice, legal advice, or financial advice. All calculations, reports, and outputs are provided for informational purposes only. You are solely responsible for the accuracy of your tax filings. Consult a qualified tax professional or attorney before making any tax or investment decisions based on information from the Service.

CostBasis makes no representation that the calculation methods used comply with any specific jurisdiction's tax requirements. Tax laws vary by country, state, and year and change frequently.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Notify us immediately at support@costbasis.tax if you suspect unauthorized access.

Access to certain features requires a paid subscription. Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method at the frequency you select (annual).

You may cancel at any time through the Billing section of your dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods, except where required by applicable law.

We reserve the right to change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.

You retain ownership of the transaction data and records you provide or that are imported on your behalf. You grant CostBasis a limited license to store and process your data solely to provide the Service.

You represent that you have the right to provide any data you submit, including exchange API credentials and wallet addresses. Do not submit private keys, seed phrases, or any credentials that grant spending authority over your funds.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated means to access the Service beyond normal use
• Interfere with or disrupt the security or integrity of the Service
• Resell or sublicense access to the Service without our written consent

The Service and its original content, features, and functionality are owned by CostBasis and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand names.

The Service integrates with third-party services including Clerk (authentication), Stripe (payments), Etherscan (Ethereum data), Blockchain.com (Bitcoin data), and CoinGecko (price data). Your use of those services is subject to their respective terms of service and privacy policies. CostBasis is not responsible for the accuracy, availability, or actions of these third parties.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATIONS WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSTBASIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO TAX PENALTIES, INTEREST, OR LOSSES RESULTING FROM INACCURATE CALCULATIONS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO COSTBASIS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or for any reason with reasonable notice. Upon termination, your right to use the Service ceases. We may retain your data for a reasonable period as required by law or our standard backup procedures.

We may update these Terms from time to time. Material changes will be communicated by email or by a notice in the Service at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
